1.Acceptance of Terms
These Terms & Conditions (“Terms”) are an agreement between AppSwift (“AppSwift”, “we”, “us”) and the business that creates an account for, subscribes to, or uses an AppSwift product (the “Customer”, “you”). They govern the AppSwift website and the software products and services AppSwift provides (together, the “Services”).
By creating an account, purchasing a subscription, or using the Services, you agree to these Terms. The person who creates an account confirms that they are authorized to accept these Terms on the Customer's behalf. Users invited by a Customer must also follow these Terms when using the Services. If you do not agree, do not use the Services.
2.Description of Services
Ajay Sharma, an individual developer, provides the AppSwift website and the MarineInspect software to businesses. AppSwift is the product name, not a company. The products are offered on a subscription basis. MarineInspect is inspection software for boat dealerships and marine service departments. It includes:
- A mobile app for running structured boat inspections with checklists, notes, photos, and videos.
- Customer, boat, and inspection records, inspection templates, and inspection scheduling.
- PDF inspection reports generated in the app, with links that let customers watch inspection videos.
- AI document capture and AI boat health insights on plans that include AI.
- A web portal where Dealer Admins manage the team, inspections, subscription, storage, and AI usage.
Features available to a Customer depend on the product and plan. We may improve and change the Services over time. Where a product has additional terms shown in the product or at sign-up, those terms also apply.
3.Accounts
A Customer account is created on the AppSwift website by its first administrator (for MarineInspect, the Dealer Admin). The Customer must provide accurate information, keep it up to date, and is responsible for all activity under its account. Each Customer's data is kept separate from other Customers' data.
Administrators invite the other users of the account and assign their roles. Each user must keep their password confidential and must not share their account. In MarineInspect, there is no public sign-up in the mobile app, each account can be active on one registered phone at a time, and every active user uses one paid seat.
An administrator can deactivate a user at any time. A deactivated user can no longer use the Services, and their seat becomes available. Records the user created stay with the Customer so its history remains complete. Each person can also delete their own login in the MarineInspect app under Settings, then Account, then Delete account. Deletion removes the login and personal details. Records the person created stay with the Customer, under the name “Deleted user,” unless that person is the only active Dealer Admin and confirms that the dealership's records should be deleted as well. Deleting an account does not by itself cancel a Cashfree or Stripe subscription.
4.Subscriptions and Billing
- Subscriptions are purchased on the AppSwift website and billed monthly in advance. Each plan's price, included users, minimum number of users, and price per additional user are shown on the pricing page and at checkout at the time of purchase.
- Subscriptions renew automatically at the start of each billing period until cancelled.
- Administrators can change the plan or number of seats in the web portal. Changes made during a billing period may be prorated, which can result in an additional charge or a credit toward future invoices.
- Prices do not include taxes unless stated. Where taxes apply, they are added to the amount charged and the Customer is responsible for paying them.
- We may change prices with advance notice to the account administrator. Price changes apply from the next billing period after the notice.
- The MarineInspect mobile app does not sell subscriptions or accept payments.
5.Payment
Payments are processed on the website by Cashfree or Stripe. The MarineInspect iOS app does not sell subscriptions or accept payments. Payment details are entered on the processor's hosted pages; we do not receive or store full card numbers. By providing a payment method, you authorize us and the payment processor to charge the subscription fees, including recurring charges and any prorated amounts, to that payment method.
If a payment fails, we or our payment processor may retry the charge and ask you to update your payment method. If payment is still not received, we may suspend or limit the Services, for example by blocking new uploads and AI features, or cancel the subscription. Your existing records are not deleted because a payment failed.
6.Free Trials
AppSwift does not currently offer a fixed-length free trial. A new account can be created before the first payment, and nothing is charged until a subscription is purchased at checkout. We may limit or suspend an account that has not purchased a subscription. If we offer a trial or promotional period in the future, its length and conditions will be shown before you sign up, and you will not be charged for the trial period itself.
7.Cancellation
The Customer can cancel its subscription at any time from the billing page of the web portal, or by contacting us. Cancellation takes effect at the end of the current billing period. The subscription stays active until then, and no further recurring charges are made after that date.
8.Refunds
Refunds are handled under our Refund Policy, which forms part of these Terms. In summary, subscription fees for a billing period that has started are generally not refundable, and cancelling stops future renewals. Duplicate or incorrect charges are refunded once confirmed.
9.Acceptable Use
You must not:
- Use the Services for anything unlawful, or to record information you have no right to record.
- Upload content that is harmful, infringing, or unrelated to your business.
- Attempt to access another Customer's data, bypass device, role, or security controls, or probe the Services for vulnerabilities without our permission.
- Share accounts, resell the Services, or let people outside your business use them.
- Interfere with or overload the Services, or copy or reverse engineer them except where the law allows.
We may suspend access that breaks these rules or puts the Services or other users at risk.
10.Customer Responsibilities
The Customer, through its administrators, is responsible for:
- Inviting only people who work for or on behalf of the Customer, assigning appropriate roles, and deactivating users promptly when they leave.
- Managing registered devices, plan, seats, storage, and AI usage.
- Having a lawful basis to record its own customers' information, photos, and videos in the Services, including any notices or consents those customers require, and to share reports and video links with them.
- The accuracy of the information it records, and keeping its own sign-in details secure.
In MarineInspect, inspection results, statuses, notes, and reports reflect the observations of the Customer's staff. MarineInspect provides the tools to record and present them but does not inspect boats, verify findings, or certify the condition, safety, or value of any boat. Video links shared with customers can be opened by anyone who has the link, so they should be shared only with the intended customer.
AI features are available on plans that include them. AI output can be incomplete or wrong: extracted details are shown for review and saved only when a user confirms them, and insights must be checked by qualified staff before being relied on.
11.Intellectual Property
AppSwift and its licensors own the Services, including the software, design, templates we provide, and the AppSwift and MarineInspect names and logos. We grant the Customer and its authorized users a limited, non-exclusive, non-transferable right to use the Services during the subscription, under these Terms. Feedback you give us may be used to improve the Services without obligation to you.
The Customer keeps ownership of the information, notes, photos, videos, logos, and templates it adds to the Services (“Customer Content”). The Customer grants AppSwift permission to host, process, and display Customer Content only as needed to provide, secure, and support the Services, including through the service providers listed in our Privacy Policy.
12.Third-Party Services
The Services rely on third-party providers, including Supabase for hosting, storage, and authentication, Cashfree and Stripe for payments made on the website, and OpenAI for AI features after the person allows that sharing. Payments are also subject to the payment processor's terms. We are not responsible for third-party services outside our control, but we choose providers with care.
13.Service Availability
We work to keep the Services available and reliable, but they may be interrupted for maintenance, updates, or reasons outside our control. Mobile apps need an internet connection for most features. We do not offer a service level agreement unless one is agreed in writing.
14.Data and Privacy
Our Privacy Policy explains how we collect, use, and protect information, including information the Customer records about its own customers. When a subscription ends, Customer Content is not deleted automatically; the Customer can ask us to delete it by contacting us.
15.Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AppSwift does not warrant that inspections, reports, or AI output are accurate or complete, or that the Services will be error-free.
16.Limitation of Liability
To the extent permitted by law, AppSwift will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from use of the Services. Our total liability for any claim relating to the Services is limited to the amount the Customer paid AppSwift for the Services in the twelve months before the event giving rise to the claim.
17.Indemnification
The Customer will defend and indemnify AppSwift against third-party claims arising from Customer Content, the Customer's inspections and reports, the Customer's use of the Services in breach of these Terms, or the Customer's violation of law or of the rights of its own customers.
18.Suspension and Termination
We may suspend or end access if the Customer materially breaches these Terms, fails to pay, or uses the Services in a way that creates risk for others. Where reasonable, we will give notice and an opportunity to fix the issue first. The Customer can stop using the Services at any time by cancelling its subscription.
19.Changes to Terms
We may update these Terms. We will post the new version on this page with an updated date and, for significant changes, give account administrators reasonable notice before they take effect. Continuing to use the Services after the changes take effect means accepting them.
20.Governing Law
These Terms are governed by the laws that apply to Ajay Sharma, the individual developer of MarineInspect, without regard to conflict-of-laws rules. Disputes will be resolved by the competent courts of that place, unless applicable law requires otherwise.
